Terms of Service

1. Acceptance of Terms
By accessing or using Dundie Merch ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. IMPORTANT: Dundie Merch is an independent community-built merchandise platform. It is not affiliated with, endorsed by, or officially connected to the original Dundies District NFT project creators, Metaplex, Solana Foundation, or any other blockchain entity.
2. Description of Service
Dundie Merch enables holders of Dundies District Solana compressed NFTs (collection: Ema2R3UWX5Axthmen64wUfJaG5bcoah8id2ffsbBrgeo) to license their NFT artwork for physical merchandise. The Platform operator built and maintains this service independently. The revenue split (10% holder / 20% DAO / 70% operator) reflects operational costs including print production ($20-40/item), Stripe fees (2.9% + $0.30), hosting, APIs, development, and maintenance. The operator's actual profit after costs is significantly less than 70%.
3. NFT Licensing & Intellectual Property
By registering your NFT, you grant Dundie Merch a limited, non-exclusive, royalty-bearing license to use your NFT artwork for physical merchandise only. This license is active only while you hold the NFT in your connected wallet. If ownership transfers, the license terminates automatically and your NFT is removed from the storefront. Existing orders will still be fulfilled. You warrant that: (a) you own the NFT; (b) you have the right to grant this license; (c) the artwork does not infringe third-party rights; (d) you are not circumventing any restrictions from the original creators. Platform design, code, and branding are owned by Dundie Merch. The Dundies District collection and trademarks belong to their respective creators.
4. Revenue, Royalties & Payouts
Royalty balances require a minimum of 0.1 SOL to withdraw. Withdrawals are processed manually within 48 hours of request. Royalties are denominated in USD and converted to SOL at withdrawal time based on market rates. Dundie Merch is not responsible for SOL price fluctuations. We reserve the right to adjust the revenue split with 30 days notice via the Dundies District Discord. US holders receiving over $600/year will receive a 1099-K. All recipients are responsible for their own tax obligations.
5. Shopping Cart & Multi-Item Orders
The Platform supports a shopping cart for purchasing multiple items featuring different NFTs in one transaction. Each item is a separate order for fulfillment and royalty purposes. Royalties are calculated per item and assigned to the respective NFT holder. Items may be fulfilled and shipped separately by Printify.
6. Purchases, Fulfillment & Refunds
All merchandise is produced on demand by Printify. Production and shipping typically takes 5-14 business days. All sales are final unless the product arrives defective, damaged, or materially different from what was ordered. Refund requests must be submitted within 30 days of delivery with photos to ace.crypto3333@gmail.com. We are not responsible for: incorrect addresses provided by customers, packages lost after carrier confirmation, customs delays or fees, or print quality within industry tolerances. Laser engraved tumblers will appear as metallic outlines without color. Product mockups are approximations only.
7. Payments
Payments are processed by Stripe (PCI-DSS compliant). We do not store card information. Prices are in USD. Shipping is calculated at checkout. Sales tax may be collected where applicable.
8. Wallet Connection & Security
You confirm you are the authorized user of any wallet you connect. We never store private keys. All blockchain actions require your explicit wallet approval. Message signatures are used only for: (a) verifying NFT ownership, and (b) authorizing royalty withdrawals. We will never ask you to sign a transaction that spends SOL or transfers tokens. Always verify you are on dundie-merch.vercel.app before signing anything.
9. Prohibited Conduct
You may not: register NFTs you do not own; manipulate royalty balances; use automated tools to abuse the Platform; submit fraudulent orders; impersonate others; attempt to copy or compete with the Platform; or violate any applicable law. Violations result in immediate access termination and potential legal action.
10. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE OR SPECIFIC PRINT QUALITY OUTCOMES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING LOSS OF NFT VALUE OR CRYPTOCURRENCY.
11. Indemnification
You agree to indemnify Dundie Merch and its operator from claims arising from: your use of the Platform; your NFT registrations; claims that your NFT artwork infringes third-party rights; and your tax obligations on royalty income.
12. Changes & Contact
